Woman fired for being 'irresistible'; Iowa court sides with boss

LOS ANGELES (KABC) -- Melissa Nelson spent 10 happy years working as a dental assistant until she was fired because her boss said she was too tempting and a threat to his marriage.

On Friday, the all-male Iowa Supreme Court unanimously agreed that dentist James Knight was justified when he fired an employee he saw as an "irresistible attraction."

"I'm devastated. There is not an appeal, the state is as far as we can go," said Nelson.

The decision is sparking much controversy, with some employment attorneys calling it a dangerous throwback.

"I wouldn't have been surprised if it was a decision that was written in 1970, maybe by the characters of 'Mad Men,'" said employment attorney Glen Savits.

The 32-year-old married mother of two says she saw her employer as a father-figure and was shocked when Knight admitted that even though she was great at her job, he couldn't be trusted around her.

"After working so many years side by side, I didn't have any idea that that would have crossed his mind," said Nelson.

According to court documents, Knight referenced Nelson's infrequent sex life, saying, "That's like having a Lamborghini in the garage and never driving it."

And when the doctor's wife discovered him sending text messages to his assistant, it was his wife who demanded she be fired. Nelson sued for gender discrimination.

Knight's lawyer told ABC News in a statement, "She (Nelson) was not terminated because of her gender, but to preserve the best interests of his (Knight's) marriage."

Nelson said that's sending the wrong message.

"I think it is sending a message that men can do whatever they want in the workforce," she said.

Nelson's lawyer says she has received a huge outpouring of support, with some people even offering to pay legal costs. But after three years of appealing, there can be no new appeals, because Nelson alleged a violation of state law, not federal law.

    I read about this. At first I wondered why the dentist fired her after 10 years then I read his wife saw some texts. Still, 10 years is a long time to carry a torch for someone. Honestly, if I were the wife I might want her gone too, knowing my husband was attracted to her.

    Once again, a woman is blamed practically for breathing because some man supposedly "can't control himself." This decision sets a dangerous precedent and sets women's rights back 40 or 50 years. Should we be prepared to wear burkas? Given this case, I wonder.

    Does she have a right to work at his business? He replaced her with a woman and all office staff are women so it doesn't seem to be gender discrimination.

    The dentist was attracted to her and didn't want to be tempted by continuing to work with her (or the wife didn't want it, either way). His nor the wife's problem was the assistant being a woman, it was him being attracted to her looks. I don't get why this was a court case and agree with the lower court's original decision. "Beauty" is not a protected class.

    Bc she was pissed she got thrown under the bus and lost her job, and she wanted them to pay! And I'm not mad at her. LOL

    But no one ever said it was a sex discrimination case.

    She was hoping it would fly as wrongful termination on some other, more nebulous grounds.

    The original linked article above has the dentist's attorney saying this was not a gender based decision, which made me think that was her claim. I haven't seen what the actual complaint states.

    Nelson did claim gender discrimination.

    What chaps my ass the most about this is the assumption that an affair would have happened if he decided it, as if it was a foregone conclusion that she would have went along with his hypothetical advances.

    She should have sued for sexual harrassent for his innuendos.

    I hope that stupid POS and his moron of a wife have a miserable marriage for the rest of their lives. They deserve it.

    That was very definitely the assumption in the various articles I've read. It wasn't just the fantasy (and let me just say, if (general) you are trying to control your partner's thoughts, well...good luck with that, honey), it was that if she stayed in that office, he would have an affair with her.

    That was very definitely the assumption in the various articles I've read. It wasn't just the fantasy (and let me just say, if (general) you are trying to control your partner's thoughts, well...good luck with that, honey), it was that if she stayed in that office, he would have an affair with her.

    Because obviously once he willed it she would succumb to his desires and sleep with him even though she was in no way attracted to him. This man is an assssssss. His wife is an even bigger one. Because women have no control nor responsibility for men's desires. He has no self control. But why should he. He is a HE.

    Yes exactly!!like if HE decided its time to have an affair, this married mother of two would just go along with it. Yeah, right. Even if he did make advances, I doubt it would lead to an affair. If he can't deal with being around attractive women, and "can't control himself" then that's his problem.

    i guess he was worried he couldnt handle a lamborghini after driving a minivan all these years. not that i think its right but why couldnt he have found other legal ways to let her go? he lacks common sense and decency

    I hope she can sue for wrongful termination since gender discrim was not the issue. The worker did nothing wrong. The wife however needs to be understand that she can't trust her husband, wherever he is. So it doesn't matter who or where, he's seems like he could stray. Is she going to put a GPS on his weiner?
