I've been subpoenaed!

Back in September a lady ran a stop sign and drove into my apartment while my kids and I were home and demolished everything we owned. Thankfully I only had a broken hand and cuts and bruises, and my kids were untouched. Very scary and traumatic for us. If I hadn't looked up at the exact time she ran the sign,she would have killed me. I had to dive out of the way.

Anyway, the cops did NOT field sobriety test her or anything bc she said she "blacked out". All she got was a ticket for running the stop sign. I just received a subpoena to testify against her because she is trying to say she did not run the sign.

Is she kidding me?! She drove all the way into my home and nearly went out the other side!!!!!

    Wow, that's crazy! I'm so sorry that happened but so glad everyone was OK. I can't even imagine how traumatizing that must have been.

    Sadly, many people will lie through their teeth to try to get out of trouble. Hopefully, the judge sees right through her.

    WTF? They didn't report the damage to you and your house? I don't understand how that's possible. Can you afford a lawyer?

    I remember being so irate that all she got was the ticket and the police threatened to take me to jail!

    I was only three feet from the back end for crying out loud. Had glass all in my face and legs. I had to crawl through all the glass and metal to get to the kids. They didn't sleep for a week.

    Oh I am in the process of handling the damages. I got reimbursement for furniture but had to fight them on it and now they're trying to say I'm lying about my hand being broken in the accident.

    yes go to court and testify against her, bring pics, do everything you can, she get this crazy off the street!!!

    i'm just glad you and your family is ok, more then i can say for those dumba$$ cops.

    Just bring in that picture you have posted here.. it shows her car and license plate number. You can't dispute the photo. And you probably have to show where the stop sign is in relation to your apartment.

    how did she get home? what happend to her after the accident?

    Not that I even know what you should do with this info, but...

    Any witnesses other than your family?
    Do you know the names of the cop(s) who threatened you?
    Is there a record of your injury in a hospital somewhere?

    Yes I have all my hospital records,and I'm not sure how she got home. I was shaking and completely freaked out so I had to separate myself from her bc I was so angry I wanted to physically hurt her. She didn't even apologize!!!

    There were tons of people around but I'm not sure how to even find them.I believe the pics and my testimony will be enough to convict her though. I mean look at it, her car looks like the apt was built around it!

    I assume the officer who took my statement will be there too?
    He even took my statement down wrong! He said I was complaining of my left arm hurting, and my right hand was the one broken,so the insurance is saying I'm lying. I remember him pointing out my left arm was bleeding and cut, but I didn't mention it bc I didn't even realize! They lie so much!!!

    That sounds horrible and I'm really sorry it happened. Is this civil or criminal? If it's criminal, talk to the DA and give them photocopies of all the stuff you've got. If it's civil, I'm thinking maybe your insurance company will provide you with a lawyer because they don't want to end up paying for stuff that she should be paying for. So definitely talk to that lawyer.

    After seeing that picture, it's a wonder you and your children escaped relatively unscathed. Dang.

    I don't see how that woman escaped jail either. It's outrageous. At minimum, it's vehicular assault. I don't know what the jail time for that would be in Texas, but in NY, it's a class E felony punishable for up to 4 years incarceration. I'm assuming since she wasn't arrested at the time it happened that your upcoming court case is a civil one. IMO, it's not enough for the courts or the insurance company to make her financially liable for your medical bills and/or the material things that got damaged. She could have killed you and/or your children and that deserves jail.

    that is terrible!! she doesn't even want to take responsibility for the minimal charges filed against her. oh i'd go to court and testify and stick it to her as$!!!!!!!!

    thank goodness you're okay. that must have been horrible for you and your kids and everyone thinks you're safe at home.

    go to court, milk it and maybe she'll get into even more trouble than if she's just paid the ticket for running a stop sign. i'd definitely allude to the fact that she seemed incoherant, possibly drunk but the officer didn't seem to test her for that....just let the chips fall where they may. i don't know how she could wiggle out of that!

    I'm wondering what exactly her story is going to be! Like Oh yes I was just driving and somehow my vehicle ended up in her apartment! My best friend is coming with me,and she saw the cops when they were asking the woman questions.... She also had a passenger who apparently noticed the driver was going to crash into a tree infront of my apt, but instead the passenger grabbed the wheel and made it to where they drove into my apartment. I guess killing an entire family is better than crashing yourself into a tree....

    She's denying the assertion that she wasn't abiding by the law right- that she stopped, and then blacked out (or maybe blacked out and then 'ran' it without intentionally running it...)? To deny any involvement is just crazy.

    Sorry you had to deal with the extra crap regarding your injury considering what happened to you and your fam. That's pretty messed up.

    I can't say how grateful I an that my kids weren't hurt or killed. I must have cried for two hours that night before I finally passed out from sheer exhaustion. I still get jumpy if a car looks like it's not going to stop at a light or whatever. Yuk!

    I get a little nervous making a sharp left turn because I once had an accident doing that on wet pavement -- so I can't even imagine the flashbacks from something like you experienced.

    1) I think it's insane that she is trying to defend herself at all

    Lol that's called autocorrect my dear! But I pretty much knew how it was spelled in my own defense lol.

    I made sure our new apartment was on the second floor AND in the middle of the complex. My oldest still talks about how certain toys "got runned over". Makes me sad.

    I'm so totally disgusted for you. By far I'm no medical expert, nor detective/investigator, but the following thoughts are glaringly obvious to me:

    If she did not run the stop sign, wouldn't that mean she would have then obeyed the sign and come to a complete stop?

    If she indeed blacked out while stopped @ the stop sign, then wouldn't her body go limp? And if she was unconscious at the time, wouldn't her muscles be relaxed?

    And if she went limp, then wouldn't the pressure of her foot slip lessen on the brake pedal (or completely slip off) that she was *allegedly* pressing? If that was the case then wouldn't her car only accelerate/coast at whatever the idle is set to? (I highly doubt that her car, traveling at its idle, could gain enough momentum do that much damage.)

    So if those points are that apparent to a layperson like me, why aren't they to law enforcement???

    I pray you get the justice you so obviously deserve.

    What is your attorney saying?? Has your attorney advised you on how you should testify? Aside from your furniture, is your attorney requesting other damages from the driver's insurance company?

    It is truly a miracle that you and your kids escaped from this. So glad you're OK!

    I fired my attorney, he was shady. So for now I'm representing myself until it's absolutely necessary to seek more legal counsel.

    I'm not too worried about it,I'm just kind of disgusted she's trying to dispute the ticket itself. But,I do have a ton of pictures to verify it was indeed her who ran the sign AND drove through my home.

    I'm trying to deal with the insurance company myself as far as the injury settlement is concerned, and just praying God handles it justly. At this point I'm so tired of dealing with these people it's ridiculous.

    My lawyer made it pretty clear he basically thought of me as a single black mom out for money for no reason. That's why he got fired. Not to mention he was all around shady in general.

    I'm so over it!

    ETA: and I thought the same thing about her passing out...why would her passing out make her foot press down even more on the gas? She seemed to gain majority of her speed after blowing through the stop sign,and I would have assumed a passed out body wouldn't have the power to put that much pressure on a gas petal

    Not sure of your financial situation, but have you contacted Legal Aid? What about another lawyer from the phone book? You can always check online reviews.

    Is the driver related to someone powerful? Unless you just live in a very small town or corrupt area, the driver should have been charged with destruction of property. Even if it were because of passing out, which I don't believe, she still damaged property and drove recklessly. At the very least, you could bring it to the news to shame everyone involved. The station would love those pictures, and the fact that this lady doesn't seem to have any consequences for her actions.

    I am sending good thoughts your way. I hope things get easier because your family and you don't deserve this.

    Trust me,I was telling people to get her ass out of the car because I was gonna whoop that ass! I was scared, traumatized etc!!! I couldn't even tell the fireman my apartment number I was so out of it.

    The cop was incredibly rude,and yelling at me telling me I needed to calm down because it "isn't that serious, and your kids are obviously ok ". WHO THE HELL SAYS THAT?
